Scorching Wing Showdown Wing Eating Challenge Official Rules

 

PT’s Taverns (“PT’S” or “Sponsor”) is pleased to introduce the PT’s Taverns Scorching Wing Showdown Wing Eating Challenge (the “Challenge”) made available to the first 100 eligible individuals who register for the Challenge as described in Section 1 below. As a condition of participating in the Challenge, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Challenge or these Official Rules.

  1. ELIGIBILITY

The Challenge is only open to the first 100 eligible individuals who: (i) are legal U.S. residents, (ii) 21 years or older, (iii) are amateur eaters in good health, (iv) are not a person barred from participation in the Challenge, and (v) at all times abide by these Official Rules. You will be required to execute an Unconditional Release, Waiver, Indemnification, Hold Harmless and Assumption of the Risk Agreement prior to participation in the challenge to be eligible to participate.

ANY INDIVIDUAL WITH A SERIOUS AILMENT OR HEALTH PROBLEM MAY NOT COMPETE IN THE CHALLENGE. PROFESSIONAL EATERS, PERSONS RECOGNIZED BY THE ASSOCIATION OF INDEPENDENT COMPETITIVE EATERS OR THE INTERNATIONAL FEDERATION OF COMPETITIVE EATING, OR MEMBERS OF ANY PROFESSIONAL EATING ORGANIZATION WORLDWIDE ARE NOT ELIGIBLE TO PARTICIPATE. ALL CONTESTANTS ARE SUBJECT TO SPONSOR’S VERIFICATION AND YOU MUST BE ABLE TO PRESENT A VALID, GOVERNMENT-ISSUED ID.

Team members of Golden Entertainment, Inc. its affiliates and subsidiaries, including PT’s Taverns, its advertising agencies and promotional companies involved in this Challenge are not allowed to participate in the Challenge.

  1. TIME AND PLACE

The Challenge will take place at 1:00 p.m. local time on Friday, November 4, 2023, at PT’s Ranch located at 2430 E Pebble Rd, Henderson, Nevada (“Premises”) and will conclude by 11:59 p.m. local time on Friday, November 4, 2023.

  1. HOW TO REGISTER FOR THE CHALLENGE

To enter the Challenge, you must be one of the first 100 registrants (each a “Contestant” and collectively, the “Contestants”) to register. Registration begins at 11:30 a.m. local time November 4, 2023, on the Premises. To register, you must: (i) satisfy the eligibility requirements set forth in Section 1, (ii) be present on the Premises and complete a registration form, (iii) pay a Ten Dollar ($10.00) entry fee, (iv) agree to these Official Rules, and (v) sign an Unconditional Release, Waiver, Indemnification, Hold Harmless and Assumption of the Risk Agreement. All entry forms become the property of Sponsor and its subsidiaries and affiliates. Any form of entry and participation in the Challenge other than that described herein is void.

  1. HOW THE CHALLENGE WORKS

A.            Challenge Conducted in Rounds

At approximately 1:00 p.m. local time on Friday, November 4, 2023, Contestants will be called onto the stage in groups of five (5) Contestants (each a “Round”) for a total of 20 Rounds. A Contestant must be present on the Premises when they are called for their respective Round. If a Contestant is not in their designated eating area within two (2) minutes of being called for a Round, they are disqualified at the Sponsor’s sole discretion. Sponsor reserves no responsibility to ensure that Contestants are informed on when they are to be called up for their Round. Round order will be based on the sequential order in which the Contestants registered for the Challenge (starting at Contestant 1 going through Contestant 100). Each Contestant in the Round will be assigned a designated area to participate in the eating Challenge and will have two (2) minutes to eat as many chicken wings as they choose (“Challenge Period”).

                B.            Eating Challenge

Contestants will receive five (5) chicken wings at a time. Once a Contestant is close to finishing their chicken wings, they will receive an additional five (5) chicken wings at a time until the Challenge Period concludes. Contestants may eat either sitting or standing in their designated area using only their hands and no utensils. Contestants may use the bathroom before and after their respective Round but may not leave their designated area once the Challenge Period commences until the timekeeper declares the respective Challenge Period is completed. Judges will be comprised of team members of the Sponsor and its subsidiaries and affiliates (individually, a “Judge” and collectively, the “Judges”). Contestants must wait for the starting signal to begin eating and may not touch any chicken wings prior to the starting signal for the Challenge Period. Contestants must completely eat a chicken wing, with no meat remaining on the wing, before proceeding to the next chicken wing. After they finish with chicken wing, Contestant must place the leftover bones back in their basket in order for it to be counted the Judges. Once the end of the Challenge Period is announced by the timekeeper, Contestants must promptly place their hands down on the table or at their side. Contestants may not put additional chicken wing(s) or portions of chicken wings in their mouths after the ending signal but will be allowed fifteen (15) seconds to swallow any chicken wings already in their mouths. Contestants will not be allowed to use and/or drink any liquid during the Challenge Period; however, Contestants will be allowed to drink liquids and consume food as soon as their respective Round is completed and the Challenge Period is over.

                C.            Winner Determination

Winners will be determined based on consumption of the greatest number of chicken wings during the Challenge Period as determined by the Judges. Judges will be on hand for each Contestant to count the number of finished chicken wings as they are eaten and inspect all remaining bones to ensure there is no meat remaining. Judges reserve full discretion in determining if all the meat has been eaten off the bone and in counting the finished chicken wings. Any ties will be decided by an additional two (2) minute “eat off” between qualifying Contestants.

D.            Prohibited Actions

During a Contestant’s respective Challenge Period, a Contestant may be subject to disqualification if they conduct any of the following actions:

  • Use and/or drink any liquid or consume any other food items including sides, dipping sauces (excluding additional sauce on the wings);
  • Leave their designated area;
  • Have any other individual touch their wings or assist in any way;
  • Use a napkin or clothing from their person or anyone else;
  • Touch or otherwise manipulate the wings before, during or after the Contest Period;
  • Consume multiple chicken wings at the same time;
  • Use any kind of utensil;
  • Use the bathroom;
  • Pick apart the meat off the bones of their chicken wing;
  • Vomit, regurgitate, or spit out any substance from the mouth within two (2) minutes of the end of their respective Round or at any time on the Premises (other than the restroom after the two (2) minute mark above);
  • Start prior to the start signal;
  • Continue to eat after the ending signal; and
  • Fail to completely eat a chicken wing before beginning to eat another chicken wing.

In addition to the prohibited actions above, a Contestant may be disqualified, at the Sponsor’s sole discretion, if they complete a false or incomplete entry form or liability waiver, have any health risks that could jeopardize the Contestant’s or other individuals health or well-being; are visibly impaired, have an appearance that is deemed not hygienic or inappropriate; and are a professional eater a part of a professional eating organization.

  1. PRIZES:

The following prizes will be awarded in the form of a check in U.S. Dollars to the top three (3) Contestants who consume the most chicken wings within the Contest Period as determined by the Judges.

  • 1st Place – Two thousand five hundred dollars ($2,500.00)
  • 2nd Place – One thousand dollars ($1,000.00)
  • 3rd Place – Five hundred dollars ($500.00)

The total ARV of all prizes awarded is four thousand dollars ($4,000.00). All prizes are denominated in United States dollars.

WINNERS ARE SOLELY RESPONSIBLE FOR ALL STATE AND FEDERAL TAXES OR OTHER FEES/PENALTIES INCURRED FROM PRIZES AND WILL BE SUBJECT TO A W2-G OR 1099, IF APPLICABLE. CONTESTANTS WITH CUMULATIVE ANNUAL WINNINGS VALUED AT OVER $600 WILL RECEIVE A 1099. WINNERS AGREE TO PROVIDE ALL INFORMATION REASONABLY REQUESTED BY MANAGEMENT IN CONNECTION WITH LOCAL, STATE AND FEDERAL TAX REPORTING.

  1. WINNER NOTIFICATION AND VERIFICATION:

After completion of the Challenge, potential winners will be notified by Sponsor by an announcement on the Premises. Contestants must be present when announced as a potential winner at the conclusion of the Challenge or they forfeit their prize at the Sponsor’s discretion. Sponsor reserves no responsibility to ensure that Contestants are informed on when the Challenge is to conclude. Winners must provide proper contact information, including but not limited to, email and phone number. Winners must claim their prizes in accordance with instructions provided by Sponsor at or about the time of winner notification but no later than December 2, 2023. Checks may take approximately two (2) weeks to be issued. Winners will subsequently be notified via email and/ or phone number, as provided by the potential winner, once checks are ready for pick up at the address provided by Sponsor. Winners will have two (2) weeks from the date of notification to claim their prize at which time the prize will expire and become null & void. Unclaimed prizes will not be awarded.

All winners are only potential winners until verification of eligibility and confirmation of their eligibility is subject to their continued compliance with all terms and conditions of these Official Rules. If a potential winner fails to respond to the verification notification within the designated period or the notification cannot be made after two (2) attempts, the potential winner may be disqualified in Sponsor’s sole and absolute discretion.

Except where prohibited, potential winners also may be required to sign and return to Sponsor, within five (5) business days from the date of notification, a declaration of eligibility and liability/publicity release (“Declaration”) via email to the address specified in the Declaration in order to claim his or her prize. If a potential winner fails to complete, sign and return the applicable Declaration within the required time period, or if the Declaration is returned as undeliverable or incomplete, the potential winner may be disqualified in Sponsor’s sole and absolute discretion.

In the event a potential winner is disqualified for any reason, or if a prize is unclaimed, the prize will be forfeited. Sponsor, at its sole and absolute discretion, may award the forfeited prize to an alternate potential winner based on the next highest amount of number of wings eaten. If the alternate potential winner(s) fails to respond to the notification within forty-eight (48) hours of notification or the notification cannot be made after two (2) attempts, the alternate potential winner may be disqualified in Sponsor’s sole and absolute discretion. Sponsor retains the right, but not the obligation, to repeat this process until an alternate potential winner complies with the verification of eligibility requirements.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE CHALLENGE, ANY CHANGES TO THESE OFFICIAL RULES, AND THE DETERMINATION OF POTENTIAL WINNERS IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE CHALLENGE.

  1. PRIZE RESTRICTIONS:

No more than the stated number of prizes will be awarded. Winner must be 21 years of age or older. A prize will be awarded only if the potential winner fully complies with these Official Rules. Sponsor shall have no responsibility or obligation to the prize winner or a potential winner who is unable or unavailable to, or who does not for any reason, accept or utilize the prize.

All prize details are at the sole and absolute discretion of Sponsor. No transfer, refund, substitution or replacement for a prize will be made, except that Sponsor, at its sole and absolute discretion, may substitute a prize of equal or greater value for any reason.

ALL PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

  1. GENERAL CONDITIONS:

Subject to applicable law, Sponsor reserves all rights, including but not limited to the rights to: (i) disqualify any Contestant at any time and for any reason and including (without limitation) any Contestant who is found to be tampering with the operation of this Challenge, to be acting in violation of these rules or to be acting with the intent to disrupt or undermine the legitimate operation of the Challenge; and (ii) modify, suspend or terminate this Challenge with or without advance notification to Contestants, for any reason and including (without limitation) if Sponsor determines, in its sole discretion, that the Challenge is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper administration and/or feasibility of the Challenge as contemplated in these rules. In such an event, Sponsor reserves the right to award the prizes to the extent required by law for eligible Contestants submitted up to the time of the impairment (and/or thereafter), or in such other manner as deemed fair and appropriate by Sponsor in its sole and absolute discretion.

By participating in this Challenge, Contestants acknowledge and agree to be bound by these rules and that he/she will not cheat, attempt to cheat, or otherwise interrupt or attempt to interrupt or harm the operations of Sponsor or any service of Sponsor or this Challenge. Sponsor reserves the right to disqualify any individual, and any prize awarded to such Contestant shall be forfeited, it finds to be tampering or interfering with the operation of the Challenge, acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner and void such individual’s entry.

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.

9.            RELEASE AND LIMITATIONS OF LIABILITY:

Sponsor and each of its respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents (the “Released Parties”), are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and any entries or mail which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, postage due or any combination thereof.

The wing sauce applied to the wings used in the Challenge is made with some of the hottest peppers "Trinidad Moruga Scorpion pepper" (2,009,231 units on the Scoville Heat Rating Scale). Contestant acknowledges that there are risks of personal injury, illness and possible loss of life, and risks of damage to or loss of personal property, which may result from participating in this contest. Contestant voluntarily enters the Challenge and assumes all of these risks. Contestant, as a condition of entry, agrees to indemnify, defend and hold harmless the Released Parties, and all officers, directors, employees and agents of the aforesaid entities, from any and all claims and costs, including attorneys’ fees, relating to, arising from or in connection with participation in this Challenge or the receipt or use of any prize. In so doing, contestant releases and indemnifies the aforesaid entities and individuals from liability for injuries or damages of any kind arising from or in connection with participation in this Challenge or the receipt or use of any prize. In no event shall the Released Parties be liable to a contestant, or his or her assigns, heirs, or devisees, for acts or omissions arising out of or related to the Challenge or that Contestant's participation in the Challenge.

10.          DISPUTES:

You agree that any and all disputes, claims, and causes of action arising out of or connected with this Challenge or the prizes shall be governed, construed and enforced in accordance with the laws of the state of Nevada regardless of the Contestant’s jurisdiction of residence and notwithstanding any conflicts of law principles.

11.          PUBLICITY RELEASE AND USE OF PERSONAL INFORMATION:

Except where prohibited by law, by participating in this Challenge and/or accepting a Prize, you grant Sponsor and its designees the right to use your name, photograph, likeness, statements, biographical information, testimonials, personal story, voice, address, and other identifying information for any and all commercial purposes of the Sponsor, including, without limitation, advertising and promotional purposes for this and similar contests and promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission.

By entering the Challenge, entrants acknowledge they will be sharing their personal information with Sponsor. In addition, by entering, entrants agree to Sponsor's use of entrant's personal information as described in its respective Privacy Policy. Please refer to all Sponsor's Privacy Policy, which can be found at https://www.goldenent.com/privacy/ for important information regarding their collection, use and disclosure of personal information. Sponsor is not responsible for disclosures made by any third party.

YOU FURTHER ACKNOWLEDGE THAT YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNERS’ LIST.

12.       EXTENDED MEANINGS; CURRENCY; FORCE MAJEURE:

Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. The Released Parties are not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, pandemics, event cancellations, fires, strikes, floods, acts of God or the state’s enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.
